OMMA Emergency Rule Updates Now in Effect — Key Compliance Changes
Effective July 12, 2025, OMMA has implemented emergency rules tied to recent legislation (HB 2807, SB 518, SB 774, SB 1039, SB 1066) impacting dispensaries, growers, processors, and manufacturers. Growers and processors must now pre-package all medical marijuana (flower, trim, pre-rolls, etc.) in sealed, tamper-evident retail-ready units before transferring to dispensaries (OAC 442:10-7-1, 10-7-2). Dispensaries are barred from accepting loose “deli-style” product starting June 1, with a sell-through grace period ending Nov. 1. Other notable changes include updated packaging requirements, including a new warning label and clear display of packaging date (OAC 442:10-7-1(d)(2)), and stricter labeling rules banning branding that appeals to minors.

New warehouse permits for licensed transporters allow temporary off-site storage (OAC 442:10-3-1, 10-3-6), and national fingerprint background checks are now required for all commercial licensees and employees (OAC 442:10-5-1.1). Also, commercial applicants must now pay license fees within 45 days of OMMA approval (OAC 442:10-4-1(b), et al), and rejected applications must be corrected and resubmitted within 30 days (OAC 442:10-2-1(b), et al).
